Impact in re-negotiation

Do the parties have to consider the potential impact of re-negotiation of existing arrangements and whether that is likely in their partnership arrangements?

Re-negotiation of existent information sharing arrangements is only required in the same degree that it would be with SASPI or Gold Standard. If existent arrangements are no longer applicable and need to be reviewed then potential re-negotiation has to happen.

The ICO Data Sharing code of practice recommends regular reviews of these agreements, however a review doesn’t imply the arrangement have to be changed unless there is a need for it. For further information on this regard, check the ICO Code of Practice, in particular their specific advice on reviewing your data sharing agreements.

The IS Toolkit minimises the need for general re-negotiation. Because the Toolkit is granular, allows smaller on-going reviews with only the relevant people at different points in time (when and as required). Delegation should be used as established across the partnership from the more strategic matters to the more operational; this approach minimises the need for exhausting big reviews but instead a more practical and real life approach.
